TERMS AND CONDITIONS OF USE AND PRIVACY POLICY

IMPORTANT – PLEASE READ

This is the Student Wiki (the "Wiki") which is operated by Leeds Metropolitan University of Civic Quarter, Leeds, LS1 3HE (email: www.leedsmet.ac.uk], telephone 0113 283 2600). Leeds Metropolitan University is referred to in this policy as "we", "us" or "our". By using this Wiki you agree to these terms and conditions, including Appendix 1 (the "Terms and Conditions"). If you do not accept them and do not intend to be bound by them then you must not use this Wiki and must exit it immediately. Your continued use of this Wiki will constitute acceptance of these Terms and Conditions.


(A) YOUR USE OF THIS WIKI

1. Access

1.1 We do our best to ensure that the Wiki operates properly at all times but we make no warranties as to the availability or accessibility of the Wiki (save as otherwise set out in these Terms and Conditions). We will not be liable for any damages, losses, costs or expenses incurred by you as a result of any lack of availability or accessibility of the Wiki.

1.2 Where any user is in breach of these Terms and Conditions, we reserve the right, but shall not be required, to provide a warning to such user for failure to comply. Further, we have the right to ban any user from the Wiki at any time, whether or not any prior warning has been given.

1.3 This Wiki is intended for use by and is directed solely at, people accessing it from the United Kingdom.

1.4 These Terms and Conditions may change from time to time and you should review this page on a regular basis. If you continue to use the Wiki after any such amendments have been made you will be deemed to accept those amendments. You may access these Terms and Conditions at any time by accessing the link to them which appears at the bottom of each page of this Wiki.

1.5 You will choose a username and password on completion of registration. You are responsible for all actions taken under that username and password and shall only use the Wiki using your own username and password. You must use every effort to keep your password safe and should not disclose it or permit it to be used by any other person.

1.6 If you lose or forget your password, please contact the system administrator.

2. Content =

2.1 We may, but we are not obliged to, screen or monitor the content (including your submissions) on the Wiki. We reserve the right to alter, delete, adapt, take down or in any other way amend the whole or any part of this Wiki at any time and without notice.

2.2 In using the Wiki you acknowledge that any opinion or representation posted on the Wiki is made by another user and is not an opinion or representation made by or on behalf of Leeds Metropolitan University.

2.3 We do not make any warranties, representations or undertakings about any of the content of this Wiki (including, without limitation, any as to the quality, accuracy, completeness or fitness for any particular purpose of such content) and cannot be held liable for any use or reliance you may make of or put on it except as specifically agreed with us in any further agreement that we may make with you in writing.

2.4 This Wiki may contain links to other websites which may be of interest which may include websites which are not based in the UK. These links are provided for your convenience only and we have no control over and do not endorse nor are in any way responsible for the content of such websites. Those third parties may offer for sale generally or directly offer to you products or services and any purchase of such products or services shall be directly between you and the third party. In no way shall we be liable for any such products or services and we do not make any representations or give any warranties or recommendations in respect of such products or services. The links to such websites and any images or information relating to such products or services which appear on this Wiki are provided for information and convenience only.

3. Submissions

3.1 You agree not to do any of the following: • defame, abuse, harass, stalk, threaten or otherwise violate or infringe the rights of any person or entity (including, but not limited to, rights of intellectual property, confidentiality, or rights of privacy); • upload or transmit through the Wiki any material which is unlawful, indecent, defamatory, hateful or racially, ethnically or otherwise offensive or objectionable, politically sensitive or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety; • create articles relating to our current employees, current students or yourself; • upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents; • advertise, trade, sell, purchase or otherwise conduct business transactions, on or via the Wiki; • upload material protected by rights of confidentiality or privacy of publicity unless you have received all the necessary consents; • act in breach of the GNU Free Documentation Licence or in any way that may destroy the GNU Free Documentation Licence relevant to any Wiki content; • use the Wiki (or any part thereof) for any illegal purpose and agree to use it in accordance with all relevant laws; • upload or transmit through the Wiki any computer viruses, macro viruses, trojan horses, worms, corrupted files or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer; • use the Wiki (or any part thereof) in a way that may cause the Wiki to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the Wiki is in any way impaired; • where you are not the author of any material you are uploading to the Wiki, delete any author attributions, legal notices or proprietary designations or within the material • falsify the origin or source of software or other material contained in a file that is uploaded; • use textspeak or "leetspeak" in your contributions; • download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner; • impersonate any person or entity nor attempt any unauthorised access to any part or component of the Wiki; and agree that in the event that you have any right, claim or action against any other user arising out of that user's use of the Wiki, then you will pursue such right, claim or action independently of, and without recourse to us; nor • use the university name to endorse or promote any product, opinion, cause or political candidate. Representation of your personal opinions as institutionally endorsed by Leeds Metropolitan University or any of its faculties or organisations is strictly prohibited.

3.2 It you become aware that any other user of the Wiki has misused the Wiki, including any breach of that user's obligations under Clause 3.1, [you will use reasonable endeavours/we encourage you] to notify us of such misuse in order that we may consider appropriate action. Please contact a sysop in this situation.

3.3 This Wiki is a collaborative project which reflects the sum of the contributions made by its users. Accordingly, if you become aware of misuse of the Wiki as described in Clause 3.2 above, we encourage you to delete or make changes to the relevant content in order to rectify the misuse.

4. Ownership Rights

4.1 Permission is granted to copy, distribute and/or modify the Wiki content under the terms of the GNU Free Documentation Licence, Version 1.2, or any later version published by the Free Software Foundation, with no Invariant Sections, no Front-Cover texts, and no Back-Cover texts. (A copy of the GNU FDL Version 1.2 is included as Appendix 1 to these Terms and Conditions.)

4.2 We grant no rights whatsoever to use or reproduce any trade marks or logos which appear on this Wiki (such as those relating to Leeds Metropolitan University) except as specifically permitted in accordance with these Terms and Conditions.

(B) PRIVACY POLICY

5. Your Personal Data

5.1 We are required by law (in particular by the Data Protection Act 1998) to comply with data protection requirements in the way in which we use any personal information collected from you through your registration for, and use of, this Wiki. We therefore take very seriously our obligations in relation to the way in which we use your personal information.

5.2 When you use the Wiki it is necessary for us to collect certain information about you. This will include your name and e-mail address.. By providing us with your personal data you consent to our processing your personal data, including your sensitive personal data, for the purposes set out in these Terms and Conditions. You also consent to our transferring your information to countries or jurisdictions which do not provide the same level of data protection as the UK, if necessary for these purposes.

5.3 The personal data which we collect from you and other sources will be held and used for the proper administration of the Wiki. We will retain copies of any communications that you may send to us (including copies of any emails) in order to maintain accurate records of the information that we have received. We may need to share your information We may disclose personal data in order to comply with a legal or regulatory obligation.

5.4 We reserve the right to disclose information to third parties where necessary for the purposes of addressing a complaint made or in the event that disciplinary action is taken by Leeds Metropolitan University in connection with the use of the Wiki.

6. Cookies

6.1 This Wiki uses cookies to track your use of the web and to assist the functionality of the site. [A cookie is a small file of text which is downloaded onto your computer when you access our Wiki and it allows us to recognise when you come back to the site. We use cookies for the purpose of allowing us to understand who is accessing our site and helping us to gain a picture of use of our Wiki. If you object to cookies or want to delete any cookies that are already stored on your computer, we recommend that you follow the instructions for deleting existing cookies and disabling future cookies on your file management software. Our cookies will have the file names [insert cookie details if applicable]. Further information on deleting or controlling cookies is available at www.aboutcookies.org. 7. Accessing Your Data and Making Sure it is Accurate

7.1 You have the right to be informed of the information which we hold on you and if you have any queries in this regard please contact Martin Rushall. We may request from you a small fee to cover our administration charges of supplying this information to you. You also have the right to request us to update any records which we hold about you by contacting Martin Rushall.

(C) GENERAL TERMS RELATING TO OUR RELATIONSHIP WITH YOU

8. Limitation of Liability

8.1 This Wiki is provided on an "as is" basis and to the fullest extent permitted by law does not make and expressly excludes all representations (except for fraudulent misrepresentation) and warranties of any kind with respect to this Wiki and its contents. We do not represent or warrant that the information accessible via this Wiki is accurate, complete or current nor that this Wiki will meet particular requirements, be available, accessible, uninterrupted, timely, secure or operate without error or that it will be free from viruses or other harmful elements.

8.2 To the fullest extent permitted at law, neither Leeds Metropolitan University nor any employee or representative involved in the Wiki will be liable whether in contract, tort, statute or otherwise howsoever arising for any damages, losses, costs, claims, liability or expenses arising out of or in connection with the use of this Wiki.

8.3 The exclusion in clause 8.2 above shall apply to all damages, losses, costs, claims, liabilities and expenses of any kind whether direct or indirect or consequential, including without limitation legal costs or expenses, direct loss of profit, direct loss of anticipated savings, loss of revenue, loss of use of money, loss of opportunity or loss of or damage to property and/or any wasted expenditure or third party claims. For the avoidance of doubt, the losses as listed in this clause are intended to be distinct and severable. Nothing in this clause shall affect your statutory rights.

8.4 Nothing in these Terms and Conditions shall be construed as excluding or limiting our liability for death or personal injury resulting from our negligence.

9. Indemnity

9.1 You hereby agree to indemnify us and keep us indemnified against any and all claims, damages, losses, liabilities and reasonable costs arising from and in connection with your abuse of the Wiki and/or your breach of these Terms and Conditions.

9.2 In the event that you have any right, claim or action against any other user arising from that user's use of the Wiki, you agree to pursue such right, claim or action independently of and without recourse to us, and you release us from all claims, loss, damage, expense, costs, delays and other liability, known and unknown, arising from or in any way connected with such right, claim or action.

10. General

10.1 If any term of this agreement is found to be invalid or unenforceable, the remaining terms of this agreement, including Appendix 1, will remain valid and enforceable.

10.2 Any failure by us to insist upon or enforce strict performance by you of any part of this agreement or to exercise any right under this agreement will not amount to a waiver of any right or future breach.

10.3 These Terms and Conditions shall be governed and construed in accordance with English Law and any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
